E-cigarettes, commonly known as vapes, have evolved rapidly from a niche product into a major public health concern. While originally marketed as a safer alternative to smoking, the National Health and Medical Research Council (NHMRC) warns that vaping exposes users and bystanders to harmful chemicals and toxins.1 In response to rising health risks—particularly among young people—the Australian Government enacted sweeping legal reforms throughout 2024, profoundly changing how vapes are sold and accessed across the country.2

What is Vaping and Why the Concern?
An e-cigarette is a battery-operated device that heats a liquid (e-liquid) to produce an aerosol, which the user then inhales. They are designed to mimic everyday items like highlighters, USB drives, or pens, and frequently use sweet or fruity flavourings to mask the chemical smell.
When someone uses an e-cigarette, the substance they inhale is far from harmless water vapour. It can contain over 200 chemicals, including formaldehyde, arsenic, mercury, heavy metals, solvents, and volatile organic compounds.1 Research unequivocally demonstrates that these chemicals are harmful to human health and can cause:
- Heart disease and cardiovascular strain.
- Chronic lung damage, breathlessness, and persistent coughing.
- Throat irritation, severe headaches, and nausea.
- An increased risk of developing cancer.
In rare but severe cases, vaping may cause a life-threatening inflammatory lung condition known as E-cigarette or Vaping Use-Associated Lung Injury (EVALI). Furthermore, the lithium-ion batteries in rechargeable vapes can malfunction and explode, causing serious trauma and burns.
The “Nicotine-Free” Myth
Do not trust the label on black-market vapes. Laboratory testing of seized illegal e-cigarette products in NSW has consistently shown that vapes explicitly labelled as “nicotine-free” often contain extremely high levels of nicotine. Users can unknowingly and rapidly develop a severe chemical addiction under the false impression they are making a safe choice.1
The Nicotine Trap and Young People
Nicotine is highly addictive, and modern disposable vapes are engineered to deliver it efficiently. A single disposable vape containing a low number of “puffs” can easily deliver the equivalent nicotine of 50 traditional cigarettes, and often much more depending on the device’s size and liquid strength.
The risk is particularly acute for young people. Because the adolescent brain is still developing, exposure to high levels of nicotine can cause permanent changes to neural pathways. This can lead to impaired attention, learning difficulties, memory deficits, and can severely worsen stress, depression, and anxiety disorders.
Keeping Children Safe: A Poisoning Risk
A very small amount of liquid nicotine can be lethal to a young child. Because illegal vape packaging is often colourful and designed to look like candy or juice, children are naturally drawn to them. Keep vapes strictly out of reach and dispose of them safely.
If you suspect a child has inhaled, swallowed, or spilled vape liquid on their skin, call the Poisons Information Centre immediately on 13 11 26. If the child has collapsed or is not breathing, call 000 for an ambulance.
Navigating Australia’s New Pharmacy-Only Laws
To combat the black market and protect young people, the Australian Government introduced major regulatory reforms. The laws around purchasing e-cigarettes have changed drastically:
- General Retail Ban (July 2024): It is now strictly illegal for any non-pharmacy retailer—including tobacconists, convenience stores, petrol stations, and vape shops—to sell any type of vape or vaping product, regardless of whether it contains nicotine or not.3
- Adult Access (October 2024): Adults aged 18 and over can now purchase therapeutic vapes with a nicotine concentration of 20 mg/mL or less directly from participating pharmacies without a prescription.2 However, this requires a clinical consultation with your pharmacist to assess appropriateness, discuss dosage, and provide proof of age.
- Prescription Requirements: A prescription from a doctor or nurse practitioner is still required for anyone under 18 years of age, or for adults requiring a therapeutic vape with a nicotine concentration higher than 20 mg/mL.2
- Flavour and Packaging Restrictions: Vapes are now treated strictly as therapeutic goods. They must adhere to plain pharmaceutical packaging and are legally restricted to just three flavours: mint, menthol, and tobacco.3
